General Terms and Conditions (GTC) and customer information

1. scope of application and provider

These General Terms and Conditions (hereinafter “GTC”) apply to all orders placed via the online store Rebel Ibiza on the website www.rebel-ibiza.com.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, is acting in the exercise of their commercial or independent professional activity.

2. products and composition (special feature: upcycling fashion)

The seller offers fashion, accessories and upcycling fashion in its online store. The items are designed in Ibiza; selected items are manufactured in Portugal.
Special note on upcycling products: Some items in the “Upcycling Fashion” category are handmade one-offs or small batches. Slight variations in color, fabric structure, washing and intentional irregularities in the material (“used look”) are characteristic features of this sustainable manufacturing method. They do not constitute a material defect and do not entitle the customer to a warranty for defects, provided that the function of the item of clothing is not impaired as a result.

3 Conclusion of contract and ordering process

The product presentations in the online store do not constitute a legally binding offer, but a non-binding online catalog.
The customer can place products in the shopping cart without obligation and check and change the content at any time before sending the order using the correction aids provided.
By clicking the button that concludes the order process (e.g. “Order with obligation to pay”), the customer submits a binding purchase offer for the goods contained in the shopping cart.
Confirmation of receipt of the order is sent by automated e-mail immediately after the order has been sent. The purchase contract is concluded:
- when selecting the payment method PayPal or Google Pay at the time of confirmation of the payment instruction by the customer;
- If credit card is selected, the customer’s credit card will be charged.

4. prices and taxes

All prices are total prices in euros (€).
VAT note: Due to the tax status of the provider (special regulation for small businesses or applicable exemption regime under the EU VAT Directive), no sales tax (VAT/IVA) is charged and this is not shown on the invoices.
Shipping costs are added to the indicated product prices. Information on the shipping costs will be displayed during the ordering process.

5. terms of payment

The following payment methods are available to the customer in our store:

PayPal: Processing takes place via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A. The PayPal terms of use apply.
Google Pay: Payment is made via the Google Pay app. The customer must be registered there.
Credit card: The credit card will be charged immediately upon completion of the order process via our payment processor.

6. delivery and shipping conditions (worldwide fulfillment)

Delivery is worldwide.
Physical fulfillment (storage, packaging and shipping) is handled by our logistics partner GrünAixtema in Aachen (Germany). The goods are therefore shipped from a German warehouse.
For deliveries to countries outside the European Union (third countries, e.g. Switzerland, USA, Great Britain), further costs may be incurred in individual cases for which the seller is not responsible and which are to be borne by the customer. These include, for example, costs for the transfer of money by credit institutions or import duties or taxes (e.g. customs duties).

7. reservation of title

The delivered goods remain the property of Rebel Ibiza until full payment has been received.

8 Warranty for defects (guarantee) and applicable law

The statutory warranty rights apply.
The law of the Kingdom of Spain shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). In the case of consumers, this choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his habitual residence (e.g. Germany).

9. online dispute resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Cancellation policy & cancellation form

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

To exercise the right to cancel, you must inform us(Rebel Ibiza, Owner: René Savelsberg, Carrer Rasclo 36, Apartamento 1, 07817 Sant Josep, Ibiza, Spain, E-Mail: info@rebel-ibiza.com) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but this is not obligatory.

You can also exercise your right of withdrawal electronically via the withdrawal button provided on our website. If you make use of this option, we will immediately send you a confirmation of receipt of such a revocation (e.g. by e-mail).

To comply with the withdrawal period, it is sufficient thats you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you.

We may refuse to refund you until we have received the goods back ator until you have provided proof that you have returned the goods, whichever is the earliest.

You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The return shipment must be sent to our Spanish address:

The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods.

Please note that for returns from countries outside the European Union (e.g. Switzerland, Great Britain, USA), the customer is responsible for the proper customs clearance of the return and must bear any customs duties or import charges that may be incurred.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
